Supreme Court allows wife’s claim 22 years after divorce to proceed

On 11 March 2015 the Supreme Court unanimously allowed the appeal in Vince v Wyatt [2015] UKSC 14; the application will now proceed in the Family Division of the High Court.

Despite the fact that the wife’s application will likely face formidable difficulties, a financial order may be justified on the basis that her contribution to the up-bringing of the couple’s child was significantly greater than that of her husband’s.

This ruling paves the way for anyone without a completed financial order to bring a claim against their former spouse regardless of how long ago they divorced.
