A pre-nuptial agreement is a formal written agreement between engaged couples, the use of which is becoming increasingly popular.

It should be noted that while pre-nuptial agreements are not binding upon the court, the courts are beginning to recognise their importance when determining financial issues on separation, divorce or dissolution.

Although the court will still need to consider all circumstances of the case, weight will be given to the contents of the pre-nuptial agreement.

The court will consider whether the terms of the agreement are fair and in particular whether the agreement favours one party over the other. The agreement should be entered into at least 21 days prior to the marriage or civil partnership and both parties should have independent legal advice.

Post Nuptial Agreement

A post nuptial agreement is a formal written agreement which is entered into following your marriage or civil partnership provides details on how the couple’s assets and property would be split in the event of the couple divorcing, separating or upon death.

A Post-Nuptial Agreement is similar to a Pre-Nuptial Agreement except that it is made after the marriage or civil partnership has taken place.
