Domestic violence can happen to anyone and includes both physical and emotional abuse. Many victims are afraid to seek help but this kind of behavior should not be tolerated and there are laws to protect those at risk.
The police have a duty to protect the vulnerable and the power to arrest a person who is inflicting domestic violence. It may be that a victim will be required to leave their home for a few days to go into a safe place like emergency housing or a refuge while the legal position is being considered.
There are various stages in the legal process that are intended to protect victims of domestic violence in the most appropriate way. Passmores can provide direction through these stages to help bring an end to the threat. We may send a warning letter to prevent any further harassment, pestering or intimidation.
In extreme cases, injunctions can be taken out to protect victims of domestic violence. There are two kinds of injunctions that can be applied for:
Non Molestation Injunction: This is for an order advising the person that they cannot harass, pester or intimidate and must not use or threaten violence.
An Occupation Injunction: This is made to regulate the occupation of a home. It can direct a partner to vacate the home or to only reside in certain rooms.
A court order will tell the person what they can and cannot do and if they breach the terms of the order they will be punished.
Domestic violence is a particularly distressing situation and finance should not be an obstacle to finding a solution. We can apply for Public Funding (Legal Aid) and if you are eligible then we can grant you this funding immediately to take court action.
Passmores Solicitors can deal with this difficult issue in a sensitive and caring manner. We are members of the Board of Trustees for the Vale Women’s Aid, so there is no doubt as to how seriously we take domestic violence and seek to help sufferers in any way we can.
