If a married couple decide to go through the process of divorce then they must demonstrate that the marriage has irretrievably broken down. The marriage can be shown to be beyond repair because:
- a husband or wife has committed adultery
- a husband or wife’s behaviour is such that a husband or wife cannot reasonably be expected to live with them
- a husband or wife left at least 2 years ago without good reason and refuses to return
- the husband and wife have lived separately for at least 2 years and they agree to the divorce
- the husband and wife have lived separately for at least 5 years
It is also possible to dissolve civil partnerships for the same reasons, although there is no ground of adultery within a civil partnership.
