A Lasting Power of Attorney
Basically a lasting power of attorney or LPA is a legal document, which is used to appoint a person(s) to make decisions on your behalf when you are unable to make those decisions by yourself due to some form of mental incapacity. These types of document are typically drawn up by people reaching retirement age but can be done at any time.
The Mental Capacity Act of 2005 established the Lasting Power of Attorney from 1 October 2007, when it replaced the Enduring Power of Attorney. The appointed attorney(s) can only use the LPA after it has been registered with the Office of the Public Guardian.
There are two main types of Lasting Power of Attorney, they are:
1) Property & Affairs LPA
As the name suggests this LPA allows you to choose a person(s) who will control the decisions regarding your financial affairs, including decisions relating to your property.
2) Health & Welfare LPA
Again as the name suggests this LPA allows you to appoint a person(s) who will be responsible for making healthcare and welfare decisions for you, including decisions relating to medical care and living arrangement.
